10-28-08  Machinists Western Pa Second Annual Golf Outing

Machinists Members in Western Pa recently held their Second Annual Golf Outing to benefit the Machinists Non-partisan Political League at the Donegal Highlands Golf Course in Donegal Pa. Outing Chair and District 98 Organizing Representative, Tom Fullard, announced the benefit raised just over $4000.00 to benefit the MNPL, almost doubling last years amount raised.

Among Local Lodges that participated this year were LL’s 52, 1060, 1976 and 1842. Also attending the dinner after the round were BR’s Tim Buck, Todd Fichera, Roosevelt Littlejohn and Robert Miller. All those in attendance received a golf wind shirt, embroidered with the MNPL Logo.

10-21-08 MNPL Checks presented to Congressmen Mike Doyle (D-PA14)  and Tim Murphy (R-PA18)

Tom Fullard   and    Rep. Mike Doyle

Rep. Tim Murphy and Tom Fullard

You can’t pass Labor Friendly Legislation without the electing representatives who have labors concerns in mind.” States Tom Fullard, MNPL Coordinator West, and Organizing Representative for District Lodge 98.

MNPL Contributions were distributed to Congressmen Tim Murphy and Mike Doyle of Western Pennsylvania by MNPL Coordinator West, Tom Fullard – also an organizer for District 98. Before the checks were presented however, Fullard made both representatives aware of how badly employees need another option to organize their workplaces. “At the top of Labors legislative agenda is the Employee Free-Choice Act” said Fullard. “It was a great opportunity to share a story of one of our organizing campaigns, and how the current NLRB process is tilted toward management and its border-line criminal conduct in an election process.” In 2006, the Dura- Bond company in McKeesport used thinly veiled threats of shuttering the plant, or moving the work to an off-shore location during the 42 days between filing, and the election. More than 80% of the employees had signed authorization cards, but on election day, employer intimidation lead to a dismal defeat for the employees. Had the EFCA been an option, the group could have had the IAM as its certified collective bargaining agent within days of the filing the cards.

Also discussed was the importance of the Boeing company and the Air Force Defense contract award to a foreign entity. The Boeing Company does business with more than 690 companies in Pennsylvania and many of them are represented by the IAM.

10-20-08  Kathy Dahlkemper presented with MNPL Contribution

Tim Buck, District Lodge 98 Assistant Directing Business Representative presents Kathy  with a check for $5,000 from the Machinists Non-Partisan Political League (MNPL). Kathy is willing to sign onto the "Employee Free Choice Act".  Kathy was very appreciative and said thank you for this donation.

NOTE: All Political donations come from voluntary donations raised for MNPL  -  NOT FROM DUES MONEY

4-1-08  Lock out continues at Philadelphia Mixers Corp. LL 2367

The Lock-Out (strike) by members of Local Lodge 2367 employed by Philadelphia Mixer Corp in Palmyra, PA continues strong into their 5th month.  The 14 union members were locked out after their old contract expired and the union refused to cave into the employer unreasonable demands to cut the wages and benefits and rewrite the contract language that had been in effect for decades.  The Pennsylvania unemployment bureau has ruled against the workers in their unemployment case, but we have appealed that decision.

5-5-07 Third Circuit Court of Appeals rules for Union in Lancaster Nissan case

The Third Circuit Court of Appeals has ruled to affirm the National Labor Relations Board (NLRB) and the Administrative Law Judges (ALJ) order against Lancaster Nissan, Inc. The NLRB AND THE ALJ had ruled the company violated the Federal Labor Law when they refused to bargain with District 98 at reasonable times during the certification year, and withdrew recognition. The NLRB ordered the company to continue to recognize the union and return to the bargaining table. The company appealed the ALJ's ruling to the full NLRB in Washington, DC. When the NLRB affirmed the ALJ's ruling the company appealed to the Third Circuit Court of Appeals.

Bob Myers,  District 98 Organizer, organized these employees in September 2002. District 98 Business Rep. Clark Ruppert, Jr. filed the unfair labor practice charges against the company in October 2003.

As of this date we do not know if the company will return to bargaining table or continue to stall by appealing the Third Circuits decision.

These workers have been denied a fair union contract for almost five (5) years This is just ONE of the many reasons why WE (YOU) MUST get our US Senators to pass the "EMPLOYEE FREE CHOICE ACT"!  To read more about the Employee Free Choice Act go to WWW.GOIAM.ORG  to take action click here. District Lodge 98 and the Central Labor Councils have post cards to fill out and returned to us, we will then send them to the National AFL-CIO who will get them to your Senators. If you have not filled out a card please see your local lodge officers, shop stewards.

National Magazine Misleads Seniors on Part D

A recent ad in Parade Magazine and elsewhere regarding the Part D open enrollment season that ends December 31 is deceiving readers.  The ad, placed by the Centers for Medicare and Medicaid Services (CMS), an agency of the U.S. Dept. of Health and Human Services, features a checklist where the second step incorrectly states, “If you are satisfied with your current cost, coverage and the customer service you receive, you don’t need to do anything.” The ad fails to explain that costs and coverage have changed for many of the prescription drug plans.

“CMS should explicitly mention that many plans have changed and while you may be happy with your current coverage, you need to make sure it will be there in 2007,” said Edward Coyle, Executive Director of the Alliance for Retired Americans. “The misleading nature of this ad follows the trend of CMS not revealing the entire truth about Part D to the public

Last year, while CMS and the Bush Administration were peddling the so-called benefits of Part D, CMS failed to mention that nearly 7 million beneficiaries would fall into what is now known as the “donut hole,” added Coyle. “Part D is still flawed, and deceitful ads such as the one by CMS won’t cover that fact.”

Business Representative Tim Buck reports that the Steris Corp. plant in Erie, Pennsylvania is closing and moving to Mexico. There are 9 IAM Members and about 260 UAW members employed by Steris.

Thanks to NAFTA, the company can EXPLOIT the workers in Mexico for about a $4.00 cost per hour compared to our wage and benefit package cost of $38.00.

 3. Contact Steris and let them know that you are opposed to their moving to Mexico and that you will Boycott the use of units made in Mexico.

2-17-06 NLRB Judge rules for the IAM in Valley Honda

IAM District Lodge 98 recently received a favorable decision in the Valley Honda unfair labor practice case.  The Administrative Law Judge ruled that Valley Honda must sign and abide by the ratified contract and cease and desist from all unfair labor practices.  Business Representative Todd R. Fichera said that this is a major victory for the employees at Valley Honda, and the Union will pursue getting all Valley Honda employees the back pay and benefits that the Union negotiated for them.

The union negotiated with the company for a first union contract. After the members ratified the contract the company refused to sign. The union was forced to file unfair labor practice charges against the company, to sign and honor the contract.

Valley Honda is in Monroeville, PA.

 Thanks Todd

9-23-05 Ongoing Rise in Health Insurance Costs Threatens U.S. Coverage System, Survey Finds
Robert Wood Johnson survey finds business leaders predicting a 12 percent rise in health costs

The average annual cost of health insurance for a family of four increased by 9.2 percent this year, which is “far ahead of both general inflation and workers’ pay increases,” according to an annual survey by the Kaiser Family Foundation and the Health Research Educational Trust, reports the Washington Post. The average annual cost of health insurance for a family of four was $10,880 this year, with $8,167 paid for by the employer and $2,713 by the employee. The total cost amounts to about the annual earnings of a full-time minimum wage worker. Since 2000, premiums have risen by 73 percent, while wages have gone up by 15 percent. The 9.2 percent increase this year is less than that of previous years—it grew by 11.2 percent in 2004 and 13.9 in 2003—but continues a trend. “The good news, if there is any good news, is the rate of increase is lower, and the bad news is that that’s the only good news,” said Kaiser Family Foundation President Drew E. Altman.

The results were “the latest sign that a relentless rise in premiums threatens to collapse the central pillar of America’s health insurance system: job-based health coverage,” according to the Los Angeles Times. “What we are seeing is an unraveling of the way we finance healthcare in the United States,” said William Custer, director for the Center for Health Services Research at Georgia State University.

The increase is compounded by employers, especially in small businesses, who are “equally hard pressed by rising costs.” In response, they are increasingly dropping health coverage as a benefit, or offering plans that require higher costs of employees. The survey found that about 20 percent of employers now offer “consumer-driven” high-deductible health plans, which shift more costs and responsibility onto employees, reports the Boston Globe.

DOD Decision Could Cut C130, F/A 22

The proposal by White House and Department of Defense (DoD) officials to terminate C-130J transport and F/A-22 fighter production could jeopardize national security and severely affect IAM jobs at Boeing, Lockheed Martin, UTC and numerous vendors.

For more than 50 years the C130 aircraft has been a workhorse for the U.S. military, reliably transporting troops and supplies around the world. The aircraft also functions as a highly recognizable symbol of the U.S. commitment to peace, most recently delivering personnel and supplies in support of the tsunami relief effort in Southern Asia.

“Terminating the C130J would leave Airbus as the only manufacturer in the world capable of producing an aircraft in this class,” said Southern Territory GVP Bob Martinez.

The DoD proposal also would cut F/A-22 production by half in 2006 and totally eliminate production in 2008. The F/A-22 provides proven tactical dominance for U.S. forces around the world and is responsible for more than 40,000 jobs in 44 states.

“We believe the President should preserve funding for the C130J and maintain the current production schedule for the F/A-22 fighter program. The elimination of these two important programs would have a devastating effect on the economies of Marietta, Georgia and Ft. Worth, Texas, where the aircrafts are produced.”

District Lodge 98 members of Local Lodge 2171 employed by Lockheed Martin in Johnstown, PA. work on parts for the C-130.

For more information click on the links below. Please contact your US Representatives and your US Senators and tell them to continue the C130J transport and the F/A-22 fighter projects.

2-09-05 NLRB rules for the union again in Lancaster Nissan, Inc.

The National Labor Relations Board (NLRB) in Washington DC, has reaffirmed the Administrative Law Judges decision that Lancaster Nissan, Inc. violated the federal labor law.

The three member board adopted the recommended order of Administrative Law Judges Jane Vandeventer. The company appealed the Judges decision to the full Board in Washington.

Judge Vandeventer ruled that the company violated the law, when they withdrew recognition from the union. She ordered them to recognize the union, to meet at reasonable times to negotiations, provide the Union with the information requested and to rescind the two unilateral changes in terms and conditions of employment made on January 13, 2004 and make employees whole for any loss of earnings and other benefits suffered as a result of the unilateral changes made. The employer will have to post a notice on their bulletin boards for 60 days.

The union has sent the company attorney a letter requesting updated information and suggested dates for resuming contract negotiations. We are awaiting their response.

11-20-04 Lancaster Nissan - appeals  the Administrative Law Judge decision to the full National Labor Relations Board.

In another one of the company's tactics to prevent their employees from obtaining a fair and reasonable union contract

they have decided to give more money to their lawyers to fight the workers. They should stop wasting time and money by sitting down and negotiating a fair contract with the employees' union.

10-13-04 News from Aberdeen Proving Grounds, MD.

Just a little bit of Local 2424 News from APG MD. - DL98 Business Representative, Henry Scott represented an employee from Sverdrup Technology who was terminated from employment due to a security clearance issue. The case was closed -But BR Scott was able to reopen the case with the government and negotiate the employee back to work. Terminations of Security Clearances are non negotiable. This is a very big victory for this Lodge.

Also, Collins and Aikman Negotiations. BR Henry Scott and the negotiating team negotiated a new contract. The employees voted to strike with the company’s last and final proposal. The strike vote was 249 to 3. The Union membership is very strong in this plant and they stuck together. The company called BR Scott and the team back to the table and the Union negotiated a $300.00 dollar signing bonus along with a great contract. They also negotiated an additional one hour each day five days a week for the Chief Shop Steward to meet with the shop stewards to review grievances and such. This extra hour each day is at overtime pay.

Thanks for another good job done by our Business Representative and the Local Lodge 2424 negotiating team.

7-25-04 Federal Labor  Relations Authority (FLRA) issues complaint against the government settlement

The union's unfair labor practice charge against the federal government department of the Army, Aberdeen Test Center has been settled. The Regional Director for the Federal Labor Relations Authority, on July 6, 2004, approved a settlement agreement. It requires a posting that the Director of Command must read at a joint staff meeting of Federal Workers and Contractors. This is the first time that we have been able to link the Federal Government to interfering with a SCA/Contractor during an organizing drive. It speaks for itself. The drive is on going and hopefully we will get a recognition agreement from Sverdrup Tech.

District Lodge 98 and Local Lodge 2424 thanks BR Henry Scott and the rest of the team for a good job.

New unfair labor practice charges have been filed for the company implementing changes and denying representation in an investigation.

6-10-04 Federal Labor  Relations Authority (FLRA) issues complaint against the government

Local 2424 filed an Unfair Labor Practice Charge against the government for interfering with an organizing drive of employees that fall under the National Labor Relations Board (NLRB). The Federal Labor Relations Authority (FLRA) is issuing the complaint against Aberdeen Test Center Located on Aberdeen Proving Grounds, for interfering with an organizing drive for Service Contract employees employed with Sverdrup Technology, Inc. This case will set a precedent that will aid the IAM when they actively organize employees that fall under the Service Contract Act on other military installations.

Congratulations to District Lodge 98 Business Representative Henry Scott and Local Lodge 2424.

5-5-04 IAM POLICE OFFICERS SAVE BOY’S LIFE

On Friday April 9th Officers Charles "Butch" Stahm and Darryl Smuck, IAM members of Local Lodge 243, were on duty at the Southern Regional Police Department when a young boy knocked on the department’s back door. The boy pleaded for help for his 15 year old brother who had collapsed on the playground next to the police station while playing basketball. The two officers immediately rushed to the boy’s aid. They found the boy unconscious with no pulse, not breathing and in cardiac arrest. Butch and Darryl began cardiopulmonary resuscitation, then applied the police department’s defibrillator. The defibrillator repeatedly shocked the boy’s heart until the ambulance and emergency medical technicians arrived. The boy was taken to York Hospital and was later transferred to Hershey Medical Center. The boy has since been released from the hospital and is home with his family.

All of the officers and members of District 98 and Local Lodge 243 are extremely proud of these two dedicated public servants. Both Butch and Darryl are dedicated union members who serve on the I.A.M. negotiating committee at Southern Regional Police Department located in New Freedom, PA. We owe a debt of gratitude to Officers Smuck and Strahm for a job well done. It is members like these who make our organization great.

10-31-03 Another Organizing Win  - Area Wide Protective

After a long hard struggle with a defiant employer District 98 was successful in organizing the 45 employees of Area Wide Protective (A.W.P.). The employees of A.W.P. provide flagging service for electric utility companies. They have no medical insurance, no paid holidays, no paid vacation time. They are paid $8.25 to $8.75 per hour.

In May we had signed a majority of the employees and filed the petition with the NLRB in Philadelphia. Shortly thereafter the employer systematically and illegally began to fire, intimidate and threaten employees who were supporting the Union. Due to the number and severity of the charges filed with the Labor Board we requested that the election, scheduled for July, be postponed. Over the next several months the I.A.M. and the NLRB built a strong case against Area Wide Protective. The case was scheduled to go before an Administrative Law Judge in early October.

Just Short of the hearing before the Administrative Law Judge, the employer indicated that he wanted to settle the case. Through negotiations we were successful in obtaining a settlement that restored the jobs of the fired employees and granted them back pay. District 98 was also given recognition as the bargaining agent for the employees and we will soon be entering into contract negotiations with the Company.

District 98, wishes to thank the members of the organizing committee and all the employees of A.W.P. for their determination and hard work to bring the union to A.W.P.

We also thank District 98 Organizer Bobby Myers for his hard work and dedication to these workers and this campaign.

A Big Thanks to Eastern Territory GVP Lynn Tucker, Jr., Raymond Briggs – GLR, Dave Porter – GLR, and Tom Boger, District 98 DBR for their help and hard work in bringing these employees into the IAM Family.

Grand Lodge Representative Paul Shemanski brought both RATS in and was on the picket line with us. We wish to thank Paul and GVP Tucker for the use of the RATS.

6-7-2003 District 98 Takes Ad On Race Car

We are always looking for ways to gain recognition for District 98 and for the Machinists Union in general. Name recognition and knowledge of our Union is the key to organizing. The more working people know about us the more likely they are to turn to us for representation. Even though we represent many workers throughout the 24 counties that make up our District we are still not as well know as some of the other unions in the area.

This race car ad will help to give us greater exposure and name recognition. The car, owned by Stitley Motor Sports, was part of the Dirt Track Racing Show at the York Expo Center in January and will race at Williams Grove Speedway in 5 events from May through October. Hopefully this ad will bring us some organizing leads.
